  • Federal banking regulators are directed to investigate past and current debanking practices of financial institutions to identify unlawful actions and scrutinize potential violations of laws like the Equal Credit Opportunity Act. Regulators must consider remedial actions, including fines, consent decrees, or referrals to the U.S. Department of Justice based on evidence or consumer complaints.
  • The Small Business Administration (SBA) is tasked with requiring financial institutions under its jurisdiction to make reasonable efforts to reinstate clients who were previously denied services due to unlawful debanking.
  • The Secretary of the Treasury, in consultation with the Assistant to the President for Economic Policy, is to develop a comprehensive strategy within 180 days to combat politicized or unlawful debanking, potentially including legislative and regulatory recommendations.
  • The Executive Order encourages regulators to consider rescinding or modifying existing regulations that may enable unlawful debanking practices, promoting fair and unbiased access to banking services.

This Order became effective immediately and is intended to be implemented fully within 180 days. It builds on bipartisan congressional scrutiny, recent regulatory initiatives removing "reputation risk" as a basis for de-risking decisions, and ongoing federal and state efforts to ensure fair banking access.
