In a stark warning, Lower Saxony's Chamber of Industry and Commerce (IHKN) has expressed fears of increased financial burdens following a potential local tax on single-use packaging, inspired by the Tubingen model. Over 258 businesses affected by such a tax on single-use cups and boxes have voiced concerns about growing administrative hassles, shrinking sales, and escalating prices.

94% of these establishments predict an increased administrative burden, such as meticulous tracking of packaging use. 86% anticipate revenue decline as a result of a 50-cent surcharge, identical to that in Tubingen. Nearly three-quarters (71%) express likelihood of raising prices, while nearly a fifth (21%) may trim their offerings, and 18% might even abandon takeout food and drinks.

"Imposition of packaging taxes will bring about hefty bureaucratic and financial hurdles for businesses, without achieving the intended environmental benefits," said IHKN CEO, Monika Scherf. "The economy could be hit by another wave of bureaucracy."

IHKN highlights the issue of disparate rules, with each municipality potentially introducing different regulations, leading to a confusing patchwork of local rules, potentially creating unbalanced competition. SMEs may suffer the most due to limited resources and infrastructural challenges.

After the Federal Constitutional Court's ruling on Tubingen's packaging tax, municipalities in Lower Saxony are contemplating similar measures, with initiatives in Gottingen, Hildesheim, Cuxhaven, Emden, and even Hannover under consideration.

Tubingen has been implementing this tax since 2022. Businesses there must pay a tax on non-reusable packaging and other items. Coffee cups and pizza boxes invoke a 50-cent fee, and single-use cutlery and straws carry a 20-cent charge. The scheme is designed to reduce litter in public spaces.

Despite a fast-food operator's appeal, the Federal Constitutional Court upheld the tax's constitutionality.
