Court Upholds Rejection of Plane Tree Protection Initiative for Bremen Flood Defense
The State Court of Justice has upheld the rejection of a popular initiative aiming to protect the plane trees on the Newstead dyke. The decision, made on March 11, is final and cannot be appealed. The initiative sought to safeguard the trees from upcoming construction work that will see them felled to make way for a flood protection wall.
The expansion of flood protection facilities along the Weser riverbank, between the railway bridge and Piepe, is set to commence in the coming years. This comprehensive project aims to ensure safe flood protection for the city section, a necessity given Bremen's geographical location and the increasing threat of climate change.
The Senate had previously rejected the popular initiative in December 2022, citing the absolute priority of functional security in flood protection. The State Court of Justice has now confirmed this stance, stating that the draft law submitted for the protection of the plane trees violates this security. The planned construction measures will indeed impact the tree stands on the Newstead dyke, making their preservation impossible.
The State Court of Justice's decision is final, and the expansion of flood protection facilities will proceed as planned. While the loss of the plane trees is regrettable, the priority must be given to ensuring the safety of the city and its residents in the face of climate change.
