Excessive Weight: Overloaded Truck Causes More Than 1000 Kilos Overlimit During Transportation

In Germany, a driver and his son faced legal consequences after overloading a rental truck on the A7 highway near Bockenem in the Hildesheim district. The incident, reported by the Hildesheim police, resulted in the truck being unable to continue its journey from Kempten to Bremen due to the overload.

The truck, which was licensed for a maximum weight of 3,500 kilograms, including occupants, was found to weigh more than 4,900 kilograms. This excess weight was so significant that the tires of the truck were almost completely swallowed by the wheel arches, and the rear of the vehicle was sagging significantly.

The overload not only violated the total weight limit but also exceeded the maximum allowed axle load, a detail often overlooked in practice. As a result, the driver faces a minimum fine of 235 euros for the axle load excess, in addition to potential fines for the total weight violation.

Overloading a vehicle not only risks safety on the road but also has legal implications. Drivers are responsible for adhering to both the vehicle's total permitted weight and axle load limits. Failure to do so can result in fines, potential liability for accident-related damages, and the invalidation of insurance coverage or breach of rental agreement, leading to further financial consequences.

German law requires drivers to be proactive by using weight scales or reducing cargo to meet legal limits. When uncertain, the driver must err on the side of caution and reduce the load. These rules apply equally to rental truck drivers, emphasizing their responsibility for vehicle compliance and safety on German roads.

The overloaded truck required two additional vehicles to properly store the cargo, causing a delay in the move from Kempten to Bremen. Furthermore, the driver's license will have a point added as a result of the violation.

This case serves as a reminder to all drivers to respect the weight limits of their vehicles to ensure safety and comply with the law.
