First installment paid by Burgenland Energie to cover electricity costs

Hear this, mate! A firm from the Burgenland region is giving 'em hell to the energy company, Burgenland Energie!

Following a significant increase in electricity prices in 2022, the scrappy little company, backed by Brandl Talos law firm, headed straight to court. Turns out they were right, and the Eisenstadt District Court agreed with 'em.

The victorious company stands to receive a hearty €8,000 repayment from Burgenland Energie. But things didn't go smoothly for the energy provider; they took a swipe at Brandl Talos, questioning their "business model" with Austrian Press Agency (APA).

Burgenland Energie: Fuel for the FireThe court's verdict officially went into effect on May 4. Lawyer Patrick Mittlböck from Brandl Talos is urging other companies to follow suit: "If the price adjustment wasn't justified, the difference between the old and new consumption price can be claimed back in quite a few cases." The law firm also announced two events coming up in Burgenland to spread the word.

However, Burgenland Energie takes issue with Brandl Talos' alleged announcement of "mass lawsuits" nearly two years ago. They claim that only six lawsuits are still pending, with Burgenland Energie taking victory in four of them. These four riled-up companies now have to pay not only their legal fees but also process costs of roughly €30,000.

Two's a CrowdIn two other cases, either a settlement has been reached or Burgenland Energie didn't fight back to keep costs low for the plaintiffs, according to the company. There's some talk of Brandl Talos trying to bully companies by presenting a single, "non-representative" case.

  • The finance sector could potentially see a significant influx of cases as more companies might seek legal action against energy providers, following the positive outcome of the court case against Burgenland Energie.
  • The unfolding legal battles between energy companies and Brandl Talos law firm might also prompt the finance industry to closely monitor such cases, given the potential for repayments and litigation costs.
