Gazmanov's potential for regaining his pension evaluated by an advocate
In a surprising turn of events, Russian singer Oleg Gazmanov is reportedly seeking the recovery of a significant sum of money that he and his wife allegedly loaned to Gavorik Sargsyan in 2019. The loan, which is said to have been their entire pension savings, remains unpaid after a year of unsuccessful attempts.
According to lawyer Maria Yarmush, Gazmanov began granting funds to Sargsyan at the start of the year, and legal steps have been initiated against the debtor. If there was indeed a loan agreement between the two parties, and the debtor does not return the money, Gazmanov should take the matter to court for a decision on debt recovery.
However, Sargsyan has justified the delay in returning the funds with the start of the COVID-19 pandemic and other circumstances. After explaining the lack of money with unsuccessful investments, without providing specific information, Sargsyan has not yet returned the loan.
If Sargsyan declares bankruptcy, Gazmanov will need to prove that this was fraudulent bankruptcy to recover the funds. If bailiffs can't find anything in Russia, an enforcement proceeding will be opened against Sargsyan. If the court rules in Gazmanov's favor, bailiffs will be involved to find Sargsyan's money and property in Russia.
Lawyer Roman Kuzmin has stated that Gevork Sarkisyan, currently in custody, intends to flee the country. A criminal case has already been opened against Sargsyan, and Yarmush suggested that Gazmanov and his representatives should also initiate a lawsuit against Sarkisyan in the US.
It is important to note that Sargsyan had been trusted by Gazmanov's family since 2016. However, the ongoing legal battle highlights the risks of lending large sums of money, especially when the borrower's financial status is uncertain.
