German Authorities Arrest Two Illegally Working Macedonians, Employer Faces Aiding Charges
German authorities have initiated criminal proceedings against two individuals found working illegally at an Asian restaurant in Castrop-Rauxel. The employer also faces charges for aiding and abetting their illegal residence and employment.
On August 9, 2023, customs officers raided the restaurant following a tip-off. They discovered two workers who could only produce photos of their Bulgarian ID cards for identification. Further investigation revealed that both individuals were Macedonian citizens, in possession of valid passports, but without residence permits allowing them to work in Germany. It was later found that their identification documents were forged.
The employer is now facing severe consequences. They could face up to ten years in prison and a fine of up to 500,000 euros for aiding and abetting illegal residence and the illegal employment of workers without valid work permits. This case highlights the importance of proper documentation and permits for foreign workers in Germany. Without such permits, workers may end up working 'black', without health or accident insurance, and with no claim to old-age provision or unemployment benefits. This also allows employers to save on contributions, potentially increasing their profit illegally.
The two individuals have been charged with illegal residence, while the employer faces proceedings for aiding and abetting their illegal employment. This case serves as a reminder of the rights of EU citizens to work freely within the EU, while non-EU citizens require proper documentation and permits. The severe penalties for violations underscore Germany's commitment to fair labor practices and the rule of law.
