Marsh USA Sues Alliant for Poaching Surety Employees and Clients

Marsh USA has launched a lawsuit against Alliant Insurance Services, alleging poaching of key commercial surety employees and clients. This is the second such case in less than a year.

Marsh accuses Alliant of inducing employees to breach non-solicitation and confidentiality agreements, leading to Glenn Pelletiere, Marsh's commercial surety leader for the Northeast, resigning and taking three key employees with him. Following Pelletiere's departure, Alliant began soliciting Marsh's clients, resulting in one of the largest commercial surety clients moving to Alliant.

Marsh seeks injunctive relief, business losses, legal costs, damages, and punitive damages. The company claims that as many as 70 similar cases have been filed against Alliant. In a previous case in December 2024, a judge blocked Alliant from soliciting Marsh McLennan Agency clients and later issued a permanent injunction against Alliant and former employees. Alliant argued that restrictive covenants are unenforceable, but the judge dismissed this argument, stating that New York courts will enforce them to protect employer relationships and goodwill.

Marsh is suing to enforce restrictive covenants, protect confidential information, and halt Alliant's 'campaign of unfair competition'. The case is ongoing, with Marsh seeking various forms of relief and Alliant's response yet to be fully determined.
