In a significant financial blow to Deutsche Bahn (German Rail), the Baden-Württemberg Administrative Court in Mannheim has ruled that the company must bear the entire burden of additional costs for the Stuttgart 21 rail project, estimated to be over €6.5 billion and potentially exceeding €7 billion.

The court decision, made in May 2021, marks the end of German Rail's administrative judicial route as the Administrative Court of Appeal of Baden-Württemberg (VGH) in Mannheim dismissed the company's application for leave to appeal. This means that Deutsche Bahn is solely liable for the cost overruns, excluding court costs.

The exact amount of additional costs varies slightly, with estimates indicating that they have risen beyond €6.5 billion and could potentially reach €7 billion or more. This ruling clarifies that Deutsche Bahn must cover the massive cost increases from its own resources without shared financial support from other project partners.

The Stuttgart 21 rail project, with an estimated total cost of around 11 billion euros, has been subject to additional billions in costs. However, the financing agreement from 2009 only regulates the distribution of costs up to a height of around 4.5 billion euros. Consequently, the project partners are not required to share the additional costs, as per the court rulings.

German Rail had filed an appeal and applied to the Administrative Court of Appeal of Baden-Württemberg for leave to appeal the ruling, but their application was rejected. Theoretically, German Rail could still appeal to the Federal Constitutional Court, but no grounds have been presented that would justify the admission of the appeal, according to the courts.

The court rulings pertain to the Stuttgart 21 rail project's additional costs and German Rail's legal efforts to distribute these costs among partners. German Rail's lawsuit against the state of Baden-Württemberg, the city of Stuttgart, the Stuttgart Regional Association, and Stuttgart Airport was dismissed by the court.
