The Environmental Protection Agency (EPA) has announced a proposed administrative penalty settlement with Full Cycle LLC, a wastewater treatment facility located in Ketchikan, Alaska. The settlement, which is being handled through an Expedited Settlement Agreement, pertains to alleged violations of the Clean Water Act at the Ward Cove Wastewater Treatment Plant.

The EPA claims that Full Cycle LLC failed to comply with its National Pollutant Discharge Elimination System permit (#AK0053384). Specific violations include failure to notify the EPA via the 24-hour hotline, failure to submit a 5-day noncompliance notification, missing information in the quality assurance plan, missing information in the operations and maintenance plan, and failure to update the operations and maintenance plan annually. Additionally, effluent limit exceedances for pH, 5-day biochemical oxygen demand, fecal coliform, and total suspended solids were among the alleged violations.

Under the proposed agreement, Full Cycle LLC has agreed to pay a civil penalty of $3,520. The company has also certified that all alleged violations have been corrected. This administrative penalty proceeding is governed by Clean Water Act section 309(g), with public participation rights provided under the Act and EPA regulations.

The requirements for public comment and participation are set forth in Clean Water Act section 309(g)(4) and 40 CFR § 22.45.
