In a move aimed at simplifying online transactions for consumers, Federal Minister of Justice Stefanie Hubig (SPD) has announced plans for a new electronic cancellation button in Berlin. The proposed button is intended to make it easier for consumers to cancel online purchases, especially financial services.

Currently, consumer protection laws in Germany provide a right to cancel purchases within a certain timeframe, usually 14 days without giving a reason. However, financial service providers have previously been able to cancel contracts indefinitely due to minor infringements of legally prescribed information obligations. This is set to change, as plans for the new cancellation button would limit the cancellation period for financial services contracts to 12 months and 14 days after conclusion (in most cases), with a 24-month and 30-day limitation for life insurance.

The new cancellation button is part of Hubig's efforts to streamline online transactions. It will be clearly visible with the label 'Cancel Contract' or an equally clear and unambiguous formulation. The button must be constantly available, prominently placed, and easily accessible for the consumer during the cancellation period. Consumers will also have the option to request direct personal contact with providers through online tools.

The plans for the cancellation button would need to be approved by the Bundestag. If approved, the button would apply to goods, services, and financial services. Financial service providers must clarify cancellation deadlines to customers more effectively.

It's important to note that there are no specific changes to online purchase cancellation rules related to the implementation of a cancellation button or adjustments to cancellation deadlines that are universally applied across all platforms. Individual companies like Deutsche Bahn have their own policies regarding ticket cancellations. For instance, Super Saver Price tickets are non-refundable, while Flex Price tickets can be canceled free of charge up to one day before the first day of validity.

The ministry stated that only minor infringements of information obligations were sufficient for indefinite cancellation of financial service contracts in the past. The new rules aim to address this issue and provide more protection for consumers.
