Artist Stuart Semple Loses Lawsuit Over "Easy Klein" Paint
British artist Stuart Semple has lost a lawsuit in a French court to the estate of conceptual artist Yves Klein, who is renowned for his signature blue colour, International Klein Blue (IKB). The lawsuit was regarding the sale of Semple's "Easy Klein Incredibly Kleinish Blue" paint.
According to reports by Artnet News, the French judge found Semple's "Easy Klein" to infringe on the Yves Klein trademark. As a result, Semple has been ordered to pay €16,000 ($18,200) in damages and legal fees. He also has two months to appeal the court's decision.
Semple released "Easy Klein" in 2021, claiming it took him a decade to develop. The artist has made products that challenge the registered trademarks of Mattel's signature pink color for Barbie and Anish Kapoor's exclusive rights to the "world's blackest black ink" Vantablack. However, he states that he was not aware of the lawsuit being filed.
Blue Bay Limited, which owns the international trademark for "Yves Klein", and Yves Amu Klein, the son of Yves Klein and operator of the Pia Gallery in Scottsdale, Arizona, filed the lawsuit. The Yves Klein Archive, in a statement to the Wall Street Journal, expressed concern about the association of Semple's product with Klein's name, reputation, and legacy.
The implications for Semple’s other products, which often function as challenges to intellectual property restrictions like trademarks or copyrights, are significant. This lawsuit underscores the risks he faces when producing art materials that directly invoke or imitate trademarked or copyrighted artistic elements.
